Helping Our Veterans Find the Care They Deserve

Updated: Nov 11

On this Veterans Day, we honor the sacrifices made by those who have served our country with courage and dedication. While it is impossible to repay them for their service, we can ensure they have access to the care and support they deserve as they age. Several programs provide essential care to our aging veterans, including benefits that help with in-home care, assisted living, or nursing home costs. However, understanding and navigating these options can sometimes be overwhelming. Working with an elder law attorney can help veterans and their families maximize these benefits and make informed decisions for the future.

Programs Available for Aging Veterans

Various programs are available to support veterans as they age, from financial assistance for medical care to state-run facilities that provide affordable long-term care. Here are two significant resources that many veterans may not be fully aware of:

  • Aid and Attendance Benefit

The Aid and Attendance benefit is designed to help veterans and their widows afford healthcare needs, ideally at home or in an assisted-living facility.  To qualify, the veteran must have served during wartime and meet certain financial requirements, including an asset limit. This benefit can be a lifeline for aging veterans who want to maintain a comfortable, secure living situation while preserving their financial resources.

  • State-Run “Soldier’s Home” Nursing Homes

Each state operates its own Soldier’s Homes to care for veterans. These facilities provide long-term care, physical therapy, hospital care, and social services at a significantly lower cost than private long-term care facilities. Accessing care through a Soldier’s Home can help veterans preserve their assets while receiving comprehensive, specialized care. This is a tremendous resource for veterans who qualify and offers both physical support and financial relief.

A good first step for those interested in these programs is to contact the local Veteran’s Office to inquire about eligibility and application requirements. Yet, even with this assistance, navigating these programs can feel daunting, especially for families who may be unfamiliar with the legal and financial aspects of qualifying for benefits. There also may be additional programs that could help support you. This is where an elder law attorney can be invaluable.

How an Elder Law Attorney Can Help Veterans Access Benefits

An elder law attorney works with older adults to meet their legal, financial, and healthcare needs. For veterans, an elder law attorney can provide specific guidance and support in the following ways:

  1. Navigating Qualification for Aid and Attendance Benefits

Aid and Attendance benefits come with financial qualification requirements, including income and asset limits. An elder law attorney can help veterans understand how to meet these requirements and, when necessary, suggest asset protection strategies to help them qualify for benefits without jeopardizing their financial security.

  2. Guidance on State-Run Soldier’s Homes

For veterans interested in long-term care at a Soldier’s Home, an elder law attorney can provide information on admission criteria and any fees associated with the facility. This can be especially helpful if a veteran or family member needs help understanding the financial requirements or comparing options.

3.       Creating a Comprehensive Financial Plan

Veterans with assets or property may worry about covering long-term care costs without exhausting their savings. An elder law attorney can help veterans develop a financial plan that includes Medicaid planning, asset protection, and any other tools to ensure they receive the care they need while preserving as much of their estate as possible.
