The Secret Role of the Ombudsman: Your Ally Inside the Nursing Home

When a loved one moves into a nursing home, families want to believe that care will be safe, consistent, and respectful. But sometimes reality looks different. A resident might experience changes in care, delays in assistance, or staff who no longer communicate. Many families feel helpless when they see something is wrong but do not know where to turn for help.

Massachusetts has a free program designed specifically to protect residents in long-term care. It is called the Long Term Care Ombudsman Program, and it exists to defend the rights and well-being of people who live in nursing homes, rest homes, and assisted living facilities.

What the Ombudsman does

The Ombudsman is an independent advocate for residents. They are not employed by the nursing home or the agency that licenses it. Their job is to listen, investigate complaints, and work with both families and staff to resolve problems while protecting dignity and respect.

Anyone can contact the Ombudsman. Residents, family members, friends, and staff are all welcome to raise concerns. Common issues include communication problems, unanswered call lights, loss of personal belongings, medication changes, or being told to move without proper notice. The Ombudsman visits facilities, talks directly with residents, and helps find solutions before issues grow worse.

They also educate staff and families about residents’ rights, including the right to privacy, safe transfer, proper notice before discharge, and the ability to participate in decisions about care.

When the Ombudsman can help

The Ombudsman can step in when a resident feels ignored or mistreated, when staff refuse to listen, or when a family member fears retaliation for speaking up. They can attempt quiet resolution through mediation or, when necessary, report serious problems to the Department of Public Health.

Residents and employees are protected by law from retaliation after making a complaint. This means that no one should ever fear losing care or employment for contacting the Ombudsman.

When legal support becomes part of the solution

The Ombudsman can solve many issues through communication and advocacy, but sometimes a problem needs a legal approach.
