Feeling Behind on Estate Planning? Here’s How to Take the First Step

If you have reached a point in life where you do not yet have basic estate planning documents in place, such as a Will, Power of Attorney, or Health Care Proxy, the new year is a good time to think about getting started. Many people delay estate planning because they feel overwhelmed, unsure where to begin, uncomfortable thinking about the future, or even embarrassed that they have waited so long.

 

The good news is that you are still here and able to take action. Starting the process is often much easier than people expect. At our Massachusetts elder law and estate planning firm, we frequently hear clients say, “I know I should have done this years ago,” or “It feels like too much. It is helpful to start by listing what you own, including:

  • Your home and any other real estate

  • Bank and investment accounts

  • Retirement accounts, such as IRAs or 401(k)s

  • Life insurance policies

 

It is also helpful to note whether any assets are owned jointly or have named beneficiaries.

 

Next, think about the people in your life:

  • Who do you trust to make decisions if you cannot

  • Who do you want to leave assets to

  • Whether any loved ones have special needs or other concerns

Step 3: Identify What Matters Most to You

Every estate plan is different because every family and situation is different. Common priorities include:

  • Making sure a spouse or children are taken care of

  • Naming someone to make medical or financial decisions if you are unable

  • Reducing family conflict or avoiding probate court

  • Protecting assets from long-term care costs

  • Planning for a loved one with special needs or a history of financial difficulty
